The funding is processed exclusively via the digital procedure.

The procedure is specified in the VwV LuKIFG. It begins with the notification of an investment measure in accordance with No. 7 VwV LuKIFG.

1. "Notify measure" form

This notification is made using the "Notify measure" form. The information listed under number 7.1 VwV LuKIFG must be entered there. The system carries out various plausibility checks. If all entries have been made and there are no errors (red triangles on the left-hand outline bar), the notification can be sent at the end of the form.

The local authority then receives a PDF file in its public authority account with details including the ID number of the measure.

Once the respective investment measure has been notified in full, the notified and planned funds are deemed to have been approved in accordance with the LuKIFG (No. 8 VwV LuKIFG).

The content of the notification is not reviewed. An audit is only and exclusively carried out as part of the random sample audit in accordance with point 13 of the VwV LuKIFG. LuKIFG funds not used in accordance with the provisions of the VwV LuKIFG can be reclaimed in accordance with No. 14 of the VwV LuKIFG.

As the LuKIFG itself does not contain a prohibition on double funding, the allocation of LuKIFG funds does not include an examination of whether the allocation of LuKIFG funds violates any prohibition on double funding that may exist in the context of another federal/state/EU grant. Violations ofany prohibition of double funding thatmay exist in the context of another federal/state/EU grant do not affect the approval of LuKIFG funds, but may lead to the reclaiming of another federal/state/EU grant.

2. Funding application form

The application for funding in accordance with point 10.1 VwV LuKIFG is made using the "Application for funding" form. Here, the measure indicated must first be identified using the ID number of the measure. Any number of disbursements can be applied for within the scope of the LuKIFG funds planned for the investment measure.

The funds are disbursed to the municipalities to the bank details selected in the "Display measure" form in accordance with section 10.3 VwV LuKIFG.

The notification of the need for funds is not checked at the time of notification of the need for funds. An audit is only and exclusively carried out as part of the random sample audit in accordance with point 13 of this administrative regulation. LuKIFG funds that are not used in accordance with the provisions of the VwV LuKIFG or that are applied for and disbursed prematurely may be reclaimed in accordance with No. 14 VwV LuKIFG and may be subject to interest.

3. Confirmation of utilisation form

This form is used to enter the necessary information for the confirmation of utilisation in accordance with No. 11.1 VwV LuKIFG and to report the investment measure as completed. This is a prerequisite for applying for the final payment for the subsidised measure in the "Declaration of funds" form.

For technical reasons, it is not possible to submit the confirmation of utilisation as long as funds have been registered for drawdown via the "Application for funds" form that have not yet been paid out to the local authority.

4. Change/cancellation of a notified measure" form

This form allows the local authority to change the details of a notified investment measure or to cancel notified investment measures altogether. Necessary changes to the details of a notified investment measure must be made at the latest when the confirmation of utilisation is submitted.

For technical reasons, it is not possible to change the details of a notified investment measure using this form as long as funds have been notified for utilisation via the "Funds notification" form that have not yet been paid out to the local authority.

5. Random checks

Each year, the regional councils check a random sample of at least 5 per cent of the completed investment measures in accordance with No. 13.1 VwV LuKIFG. For this purpose, the local authorities must maintain measure-related documents in accordance with No. 12 VwV LuKIFG.
